The question is what defect can substantially impair the use, value or safety of the vehicle. Frankly a, if you have a noise that is ongoing that just is annoying then it probably will not meet that test. However, if you have problems with your brakes or your engine which make it unsafe to drive the vehicle or substantially affect the value of the vehicle then that would meet the test of substantially impairing the use, value or safety of the vehicle.
