In order to prove a lemon law claim you have to bring the vehicle to the dealer at least three times to repair the same problem or defect. Now it’s important that we send a final chance or last chance to repair letter because if the dealer is unable to repair it after they receive that letter then we have a presumption going to trial, a presumption that the car is a lemon.

When we go to trial I would then have the consumer testify to what the problem is, we would go over the repair orders, and that they couldn’t fix the problem and then we would talk about what problems are they having now and how does that effect their use of the vehicle, their ability to feel safe driving the vehicle and sometimes we can even get into how they think it effects the value of the vehicle. But most cases revolve around safety and use of the vehicle.
